I received a phone call (at work) from Asset Acceptance saying that I owed a debt on a Providian card from 2004. The amount owed is only $480. Thing is, I have no clue as to what this is. The only Providian card I’ve ever had is one of my current cards, which was a WAMU/Providian card and is now a Chase card. It’s current, never paid late, etc.

Asset says they’ve tried to contact me and sent letters numerous times over the past years. I’ve never received a single one.  I told the lady on the phone that I would only correspond in writing and to send me a letter about the debt to my current address. I received the letter (not a dunning letter, by the way). I DV’d them as soon as I got the letter (CMRRR). Two weeks later I received their so-called ‘debt validation’. All it was was a computer printout of my name, last four, original creditor, original account #, prinicipal owed and interest owed. Nothing else. The only thing different from the original letter they sent me was they had the principal and interest broken out. There were no dates, no other records, etc.

This is not proper debt validation, correct? Since this account was never properly dunned, either, they are in violation there too, correct? I really don’t think this is my account and they have given me nothing that proves it is. They are not reporting to the CRAs. I am going to write a letter back  saying that they did not provide adequate debt validation, therefore cannot continue collection activities (including reporting to the CRAs), if they continue collection activities I will have no choice but to pursue further action. Should I say something about the SOL? They said the debt was from 2004 and the two states I’ve lived in are KY and CO (currently in CO). The OC was never on my credit reports, which makes me think this is all a farce.

My scores are all in the 700s and we are getting a mortgage on a new home. I desperately want to keep them from reporting to the CRAs. Everything I’ve read about Asset is that they are the worst of the worst for making stuff up and lying.
