This is an old MBNA account. Now with BOA.

I was never served. But their lawyers , 1st Wolpoff & Abamson and later Mann Bracken, claimed to have served me at an address that I’ve never lived at.

I’ve tried for years to settle with the lawyers with no luck.They would not take less than 90% of THEIR balance

The original amount was $9000 and the lawyers tacked on $2000. The balance on my credit report remains at $9000 and the the judgement also remains at $9000. But all letters state $11,000.

The account is now with a new law firm. I have no yet made contact with them

 

My question – Whats my best approach? How can I remove the judgement? If I settle with the law firm, will they remove the judgement and what happens to my credit report?

For one particular entry on my CR, there is *only* the CA reporting.  When I called them, they sent me 3 separate Dunning notices, one for the amount on my CR.  The rep said they automatically delete if I PIF – his manager said she wouldn’t / couldn’t do it in writing because they do this stuff through letters their lawyers have already crafted.  She also said that they weren’t already reporting and that they hadn’t sent me anything about the debt yet and that because of that, if I paid within 30 days of receiving them, it wouldn’t be reported in the first place (I was arguing with her about that because I had called because of an item *ON MY CREDIT REPORTS*).  I have since contacted the OC (not reporting) to ask about paying / how much / who to pay.  The OC gave me a single total that coincides with the sum of the 3 totals from the CA, and an address and phone number separate from the CA.  Am I right in thinking that I can pay the OC and they will pull back the debt from the CA (so the CA cannot continue to report it)?
