HI,

 I received a letter from a CA today offering to settle a very old account that had a judgement placed 11/00 in Virginia at the General District Court for 1/2 the collectable amount. Panicked, I looked online at the court records, and found only an old inactive judgement from District Court, dated 11/00 that I assume would have expired 11/10. 

Reading online, it looks as though the only way a creditor can issue a second judgement (which I don’t see evidence of) after the statutes of limitations runs out (10 years) is to have filed an abstract of the the judgement in Circuit Court as well. The original amt was 750 bucks – now at 2000 I don’t find my name online in the Circuit Court.

Do you think I still owe the judgement legally? 

 

My mom put me on the title of her house in case something happened to her. She never got my permission for this. She was taken to court by her Home Owners Association in 2004 and had a judgement placed against her. They garnished her wages and it was paid in 2005. Since my name was also on the title the judgement was placed against both of us and was on both our credit reports. She had another issue with them in 2007 and asked their lawyer (as part of the negotiations for her making payment) if they could remove the judgement from 2004 from my credit report and the did so. This year she was looking at her credit reports and saw that the 2004 judgement was never listed as satisfied so she contacted them to see if they could change the status. The lawyer entered the judgement as satisfied and the judgement has now shown up on my credit report again and it has dropped my FICO score from 793 to 703. I need some advice on what I can do to get this removed. The HOA lawyer has no incentive to help us out by having the entry removed from my report so should I even bother contacting them? Can I file with the District Court to have the judgement vacated against me since it was not my debt?

New to the boards (and credit repair) .. Want to say thanks for all of the great info here.  However, I am a bit confused about a judgement on my CR.

 

I have a judgement for a rental agreement that was filed on 11/2005 in Delaware.  I have now been a resident of New York for 3 years.  The judgement is for a small amount($611), but I am skeptical on whether or not to pay it.  Some sources say that paying a judgement will reset the 7 year reporting period.  Others say it is 7 years from the date that it was filed.  I have also heard that if I don’t pay it, the judgement can be renewed for another 7 years.  Additionally, I read in a separate post the following information:

 

New York State Residents Only:

  • Satisfied judgments remain 5 years from the date filed.
  • Paid collections remain 5 years from the date of last activity.

Since I am a New York resident, does this apply to me even though the judgement was filed in Delaware? 

 

Any help with this would be greatly appreciated, as everything else on my credit report I have found loads of information on.

Okay, so I had a BAO credit card that was charged off, it went to a CA & then it went to a law firm & then they garnished my check.  It’s now paid.  The BOA credit card as of last week has fallen off my TU & Equifax report.  Is there anyway I can get the judgement removed?  Who would I have to contact?  It’s affecting my score b/c it’s recent w/i the past 2 years & of course the more bad things I can get removed the better.  This is they only thing negative on my Equifax report other than that it’s a clean report.  I’m still working on the other two.

I finished round one of self credit repair.

 

I requested DV of a bankruptcy (bad information listed), judgement (was included in bankruptcy, bankruptcy inclusion sent prior to bankruptcy, and prior to judgement for $650), and had a few old collection accounts that I have had verified (some of which are fully bogus and should have been reported in bankruptcy).

 

Here are the questions:

-what is my next step on the judgement? It is about 4-years old, and should not have hit the court. My lawyer at the time said to not worry as it would fall off after the judge saw my bankruptcy paperwork and noted it was included. IT DID NOT! Being 4+ years ago, and 5+ years after bankruptcy, I doubt my lawyer will re-open without a fee!

-I have an old foreclosed mortgage still showing a BALANCE on one of the credit reports (other 2 do not). I have stated that i did NOT have a balance on those accounts as my reason for update in my letter. Not sure what will be the result there.  If I ask for delete, I will lose history with that account.

 

Any suggestions on those 2-above?

 

My goal? I have a 661 Transunion score now, 619 Experian, and 588 Equifax. I am trying to get a loan that requires NO judgments, and no recent collection accounts. If I pay the judgement, I would still be required to wait 1-year before applying for the loan (construction loan).

Per the advice of another site, I pulled my judgment from the court and I compared the information on it to the information on my CRs.  Then I sent a letter to the CRAs saying “Hey, btw, there isn’t a judgment matching this description with the court listed, could you please tell me where you got this info?”  (paraphrased – my judgment said it was with the district court, they said circuit court, and there were some other differences).  Equifax just sent me a letter – “We have reviewed the judgement information, case or ID # (#here)  The results are: This item has been deleted from the credit file.  If you have additional questions about this item please contact: (wrong court name and address)”

 

Also, the court does not report to the CRAs, which is what else I found out by talking to the court.  (Also, I’m in the process of figuring out how to deal with the OC and the resulting CAs, but still).  Now I wait to see if the CORRECT court shows up on my CRs.   

 

I have a federal tax lien that was included in my chapter 13 now that my chapter 13 has been discharged can the judgement be deleted?  Please advise on the best course of action to take.
