While trying to build my credit and pay down credit card bills, I’ve become very anal about late payment etc…

 

(back story)

I had a Macy’s store card, and this winter I was “given” a Macy’s American Express card; my assumption was that I moved from the traditional store card to the new American Express card; my GAP card did similar. I am currently signed up for the automatic payments for Macys, and made the assumption that the bill was only one (not two) and the monthly payment made automatically as always. Even checked my online banking regarding the payments, and noticed each statement was paid on time.

 

Well, I learned today that the store card and American Express card were two different account under my name, and the American Express was 90 days late. I spoke with the Macys account rep, and they agreed to remove the late fee if I paid the balance in full which I did. I plan on closing the account, too.

 

Now, I’m very concerned about my credit score as I know that 90 days late is a KILLER. Is there anything I can do with the credit bureaus to fix this? If they notice my other open accounts, I am never late (thank you auto payments). I understand that I am at fault for assuming differently therefore missing the payments, but I simply figured the store credit card transferred to the new one; odd to think a store having two different accounts under one name.

 

Any help would be great–thanks!

 

 

This may seem like a really stupid question, but with credit bureaus you never know what weird formula they’re going to have, so I feel compelled to double check. I have a couple of late payments on an account, even one that goes to 120 days. The account has been in good standing for almost 2 years now, though. If I write them a GW letter to ask if they could remove the late payments, they’re not going to close the whole account, right? Or will they?

This is likely answered somewhere in this forum, but I wasn’t able to find anything specific to my situation.  One of the OC’s showing on my credit report is First Premier Bank, but they sold the debt to Arrow Financial Services.  Both are listed as collection accounts.  I’ve contact Arrow via DV and PFD letters, but the First Premier Bank account is the one showing 3 late payments.  Do I contact First Premier Bank with a GW to remove the late payments (or the entire account?) or will it get removed if I get Arrow to remove the collection account?  I’m a newbie to this forum so forgive me if I didn’t follow forum protocols exactly.  Thanks for the help.

Hi Again Everyone,

 

As you have seen by my other threads I’ve been cleaning up my score.  Reports are looking pretty clean and accurate.  However, I have one account that is standing out like a sore thumb.   It’s a citifinancial account that had some screwy payment stuff when I switched from writing them checks to making electronic payments. 

 

 When this had happened I called and worked with them to clear up the accounting and made a double payment.  to “catch up”  After which the electonic payment went through and everything was ahead, or so I thought.  Apparently they counted the double payment as 1 payment or something….. I can’t exactly figure out what math they were using.  I’m thinking the Mayan calendar.

 

 I had called earlier in my cleanup process and was told nope cant remove the late payment entries.  I sent a GW letter with no luck.  I finally got around to going through all of my bank records and put together the payments I made.  It’s nothing like what they are saying.  I have a payment to them every month with the exception of the double payment month, and even then if they applied the next payments to the previous month it should be showing multiple 30 days late, until the time I made two separate payments.

 

So worst case I figured it out.  If they are mean, it should be 10 – 30 day lates while the whole accounting thing was being worked out.  However they are listing 11 – 30s, 3- 60s, and one 90 day late. 

 

I’m thinking a good will letter asking for them to correct the error.  Play dumb and say Look I have records that you were paid every month with the one exception and it looks like two payments were accidentally counted as one, can you please remove the lates from my credit reports or something like that. 

 

Any other thoughts on how to proceed would be greatly appreciated though,

I have disputed late payment entries with my auto loan creditor using goodwill letters as well as by presenting the facts as they are. They refused to remove them. The disagreement arises from the interpretation of the contract that I signed with them: they interpret it differently than I do. There is no disagreement that the account itself was paid in full, only that they consider some payments late that I believe were not late as per the contract.

 

Can I go to a small claims court to sue them for reporting lates even though they were (i.e., as per the contract should have been considered) not late? I believe I also have documented evidence of their violation of the FCRA that holds them liable as per FCRA 616 and 617 for up to $1000. But I am really interested in getting them to remove the late payments. Is that something a small claims court can order them to do if I successfully argue my case? Or is it ultimately a creditor’s discretion whether or not they choose to consider a payment as late? If latter, the system seems unfair as all the consumet gets is to insert a 100-word statement in the credit report, but as I understand it, the statement doesn’t really help the damage to the credit score.

 

I believe it would be nonsensical for them to try to show up in court to defend the case as they lose nothing by agreeing to remove the late payments. But I am still curious about whether a court even has the capacity to order a creditor to delete the late payments or if the decision ultimately is the creditor’s. I could not find the answer in the FCRA and would like to know the answer before filing the case.

I figure this is the best forum to post this question in.  I have a 30-day late payment showing on all three of my credit reports for my GEMB/American Eagle CC.  I called Friday to ask about the chance of deleting it and was said they can’t do it over the phone and gave me an address.  I then got the guts again to call them yesterday and inquire about it.  This time I was told that I was actually late November and December (but for some reason, they’re only reporting it for the December 2009 on my credit inquiries).  To be honest, that was such a crazy time for me (I was having surgeries) that I honestly don’t remember being late in November.  Anyway, I was told that in addition to those late payments, the CSR was unable to remove my Dec late payment because they are audited and they need a justified reason as to why the late payment was removed.  She gave me the example that if they had a returned mail flag on my account, then they could remove it.  She, too, gave me the address to mail my letter in.  I sent a GW letter back on Thursday so they’ll probably get it today or tomorrow.  I’m resending one today, too, just in case. 

 

So I was told on another post that those are just excuses and they can indeed remove the late payment.  So my question is, if I call again, what wording should I use?  The only reason I’m actually doing this is because I already signed a contract on a house and if I don’t get this removed, I’m pretty sure I’ll be denied a mortgage, which would suck because I was way excited I was actually buying a house.  Should I try to speak to another CSR or ask to speak directly with a supervisor?  Has anyone else had success with calling a creditor and getting a payment removed?  Thanks!!  I need words of wisdom.

 

PS – I found a backdoor number for GEMB.  Does anyone know if they will handle my American Eagle Outfitters inquiry and do they handle removal of late payments?
