We fell behind on our mortgage. After talking with the mortgage company about our finances they will not consider a loan modification as our monthly expenses exceed our take home pay. They recommended we consider short sale or if that fails a deed in lieu. We both have jobs, just too many expenses. We are meeting with a realtor next week but have a question about it. The mortgage co. said we shouldn’t send them payments because they would be rejected as it won’t be enough to cover minimum due. The realtor said we don’t want to have a bunch of money sitting in the bank and we can’t just withdraw a bunch of money cause they will question where it went. We will be paying off other bills but still have money left. They know we get paychecks and can’t really hide the money. They have already told us the won’t consider loan modification. We are not in preforclosure yet. He also said we should not do minor repairs to the house. Any advice on how we should handle this.
They have already returned payments to us because it wasn’t for the full amount to bring the loan current. We were going to try loan modification but that would make our payments higher than the current. We sent them 2 months worth of payments but even with that as of today we would be 2 months behind so she said they will most likely return that payment & we will get a pre-foreclosure notice. The lady I spoke with a supervisor and trust me, if you’ve ever dealt with Countrywide you’d know they are a bunch of idiots & this lady was the first person out of probably 10 people we talked with that actually helped! She was the only one who went thru everything and explained it all. I don’t want to go into details on those issues. But yes, because we won’t be paying a mortgage we will have extra money and we will pay off other debt. But we don’t want to have a bunch of extra cash lying around for them to come after us for more. If this makes sense.
Charles, thank you for your help. You touched on good points. We are already in default (as I said above), we have talked to the mitigation dept. We have had payments returned and have been informed most likely what we sent them a couple weeks ago will be returned. Once we are able to pay off all other debt we will have enough money to afford the house payments, but come next year we’ll have a child in college so any extra money will go towards those loans. I just wanted to make sure what this realtor told us was true. You have been a great help Charles. Thanks!
I have 1st & 2nd mortgages. I’ve sent hardship ltrs, copies of my paychecks & a summary of my finances. Mortgage co. confirms they recvd the documents but I get the impression I am at the bottom of the list cuz’ my mortgage doesn’t reset until 9/08. I’m trying to get a modification NOW because I am already struggling. Mortgage co. says they are contacting people to discuss work out plans 90 days before the loan resets. I dont want to wait that long!!!Any ideas on how to get to the top of the list for consideration?
I recently separated from my husband and am unemployed. I am looking for a job right now and after separation, my financial situation is somewhat unstable. I have little bit of savings that will last me couple months with unemployment paychecks. I have house mortgage to meet and other bills.
My boyfriend, who know all this asked me take trip for the weekend. We went to another city where his friend lives. I didn’t expect him to pay for everything but when the bill came after first lunch we had, he pretty much told me, “baby you got this, right?” so I paid. Then it became natural for him to ask me “baby you want to pay for this?” every time when the bill came. He paid sometimes and when he did, he would tell me even before we order, “I got this.” and wink at me. Then I find myself ordering something cheaper than what I would like to get. If I paid for something rather cheap without him asking, like doughnut or something, he would jeer, “4.90…you are so generous.” I also paid his tab at the comedy club that came about 100. I only had ginger ale.
After the trip I decided to break up. I packed his stuff in my house and told him to get out (he doesn’t live in my house but there were his stuff). he told me it was miscommunication and asked me for another chance.
After that, he doesn’t want to go out as much since he knows that I won’t pay. he just calls and asks me what I have in my house. He doesn’t ask if he can bring his laundry but says, “I need to do my laundry, I’ll bring it over.” when I talk about my financial situation, he says “I wish I could help.” but really it doesn’t mean anything. I feel like he’s invading my personal boundary and taking advantage of me. We’ve been together only for two months and I already feel the way I am.
hi, i live in west virginia. my girlfriend and i have a 1 year old son together. through the last year we have been locked in mortgage limbo on our house, therefore our addresses were listed as different. we were summoned to a child support hearing in which we were told that child support would only be taken out for 2 or 3 payments(i cant recall which it was) as backpay.and when we got our addresses straightened out to come back and let them know, at which time they would cease taking payments out of my paychecks. that was in oct 2010. about this time we moved into our new house but were still stuck in mortgage limbo, meaning i couldnt change my employment status or risk messing up the loan. here is where the fun really begins. No payments were taken out of my paychecks until dec 10, 2010. the first payment of $ 148 was taken out dec 10, another of the same amount was taken out on dec. 24, 2010(i get paid every 2 weeks). neither payment was sent to the child support agency until dec. 28, 2010. My girlfriend and i thought, “hey its a one time thing, no big deal, at least thats all that they will take and now its done”…we were wrong. the next paycheck had the same amount taken out and once again was not sent to the child support agency, i then started recieving letters in the mail from the child support agency stating that i was delinquent on my payments. my girlfriend and i then went to the agency this same thing occured on every paycheck for the next 2 months. payments taken out of my checks by my employer, yet not sent to the agency. after repeatedly trying to phone the agency, we finally went down to the office. while there, we were informed that it wasnt just my checks, but my employer was not sending any other employee’s child support payments in either. he was apparently up to thousands of dollars behind. they had already notified him by letter. also, while at this meeting they informed us that if we wanted to end our child support case when we got the money from my employer that we could. they told us they were leaving the case open until he sent the money in, that way their lawyers could handle it and we wouldnt have to seek outside consultation. that was in february 2011. he has never gotten it caught all the way up, so we have never been able to get the case closed. now he is over $ 700 behind again. i ask the managers where i work about it and they tell me i have to talk to the accountants, when the child support office calls the accountant they tell them that the owner does the child support, then when they call him he becomes aggresive and profane and hangs up. these payments were supposed to stop being taken out in february and its still happening. it wouldnt be as bad if the money were being sent in, because then my girlfriend could get it and we could pay our bills with it. but that’s not happening and we are falling behind on our bills and everything else and all the child support tells us is they turned it over to their attorneys and if we havent got the money in 3 weeks to come and talk to them again. i don’t understand what they expect us to do. we can’t tell the utility companies to wait a couple weeks can we? the main problem,as i already stated, is that these payments arent even supposed to be being taken out of my checks. what can i do about this? the child support bureau is clearly not that concerned about it and we are running out of options on our money. any advice would be greatly appreciated.

I live in MN but work from home for a company based out of IL. I recently started and realized in my first couple of paychecks, that they are taking out state taxes from both Illinois AND Minnesota. Someone answered a similar question on here that said there are federal regs against taking taxes out for both states. Is this true? Can someone point me in the direction of those regs/rules so I can pass them along to my company?
The company says they are correct in taking out both state’s taxes each pay period. I thought that all gets resolved at the end when I file. I know I’ll have to file in IL as a non-resident, and file in MN as a resident – with a tax credit coming back in MN for my IL taxes paid.
Which state’s taxes are supposed to be withheld on my bi-monthly paychecks? Resident state (MN) or state I am employed in (IL)?? I do know that there is no reciprocity between these two states. Please help me understand this!
In short, my husband had a credit card with his mom, when he turned 18. He forgot about the card and never was big on getting credit. His dad used the credit card, rang up I’m guessing 15k in debt. It screwed up his credit. The situation got worse. He has been getting his paychecks garnished for over 2months….he gets paid weekly and every week they take out $216. He has no idea he was ever taken to court, never seen any credit card statements, never got any letters nothing. His dad “says” he hasn’t seen anything for his mom, since he is a co applicant on the card. I was speechless and didn’t think of how to ask any questions. I plan on calling tomorrow morning to ask how long it’s been in the hands of the law firm, where they sent the court papers, when the court date was,..my mind is a mess. We really need another car and I fear we won’t be able to and we so badly need it.

My credit score for all 3 agencies is hovering right around 617. A few months ago I was at 672. My husband and I refinanced our house and for some reason that’s when my score took such a hit. Anyway…I have about $16k in cc debt. Nothing negative on my credit history except two 30 day late payments from about 2 years ago. During the birth of my 2nd child we moved to a new house while our current house was being built. I completely forgot to pay bills one month and got two 30 day late payment hits. I’ve tried to get them removed but Chase won’t budge. So all my cc’s I’m current on. Three are with chase and have $6k, & $3,500 balances with (gulp) 17.99% interest! I have tried to get them to drop it but they won’t (I hate CHASE!). I have Discover which has $5k on it at 6.99% APR and then a Kohls card with $1k and a JC Penney card with $650 on it.   The house we built is WAY expensive and is more than 60% of our combined income of over $200k/year. I give my husband 90% of my paychecks and he takes care of our combined bills and the kids daycare and mortgage, cars, insurance, etc. So how should I tackle this stupid cc debt of my own with limited funds to pay it off? We racked up the bills after moving into our new home because our spare income was so limited. I know you should not buy a house more than 30% of your take home pay but we were taking a chance and then we were able to refi last year so that cut our mortgage down by over $1k/month. When our 2 daughters are done with daycare next year we will have an extra $25k/year back in our pockets too. So we knew the mortgage would become easier to handle and we wanted our dream home.Â

Should I pay off the highest interest cards first and make minimum payments on all the other cards? Should I borrow money to pay off the high interest CCs? I do not intend to use them again and have already cut them up.

Is a money order considered certified funds? I am preparing to send off a PFD letter so I am wondering if I should specifically state that I will be sending a money order or if I can leave it as certified funds. I do not have a checking account at the moment. I have my paychecks DD onto a prepaid debit card so a money order is likely my only option.

Next step for me, I have two public records showing on my CR. I think I know what they are from. Wife’s medical debts. She was on my insurance at the time. Anyway, my concern is the following.

Nothing is reported except status dates, case number and amount (both for around 250).

If they are what I think they are (99.9%) Chance, they were both paid immediately. Yes imagine my surprise when I found my paychecks smaller. Anywho, any thoughts on where to start (like I said, nothing reported except case numbers). I want to make sure that these are at least listed as satisfied. Heck if I can get them removed bonus, but I’m not asking for divine intervention.

The judgement on my husband’s credit report is from way back when he was on unemployment. He got an extra check, they got a judgement against him for it, garnished a paycheck which took care of it, and we forgot all about it. We actually did not even know there was a judgement received. But now we know what it is for. Its listed as satisfied, and the plantiff is the State of Washington (they got the judgement against him after we moved out of the state, and we were never served or contacted, jsut noticed one of his paychecks were 550 less with his new job)
