I have not heard back yet and I saw they added another 15 bucks to my alleged past due collection account. The original creditor listed on credit report is not even a creditor I have had in the past. could be a previous collectioin but they have never mailed or called me to let me know</p>
<p>Â </p>
<p>. What do I do now? Write the CRA or send a follow up to the CA or both? In my DV letter I requested they hault all collection activities until they validate debt with me.</p>
<p>Â </p>
<p>I know some people have the opinion that the FTC considers adding to credit report before validating as illegal. Is this true?</p>
<p>Â </p>

<p>I am planing to go to school in the US this Fall for a full time MBA program. The total cost of the 2 year program would be $120-130K. After taking out my savings and other aid, I am planing on taking a student loan of $60-80K. I am an international student (not an american citizen or a green card holder) but have been working in the US for the past 3 years. I have a decent credit histroy with a score of 728 from TU.</p>
<p></p>
<p>As I am an international student, I am only eligible for private loans in the US for which I hope to get my uncle (who is an American citizen) to co-sign. Â I have started researching loan programs of some lenders and had a few questions. I would greatly aprreciate any inputs on these:</p>
<p></p>
<p>1) Which banks, in your opinion, have the best student loan programs for international students?</p>
<p></p>
<p>2) Are there any private banks that offer a fixed rate loan? All the banks seem to be offering only floating rates and I am not sure about things to look out for in this case (besides stuff like LIBOR or Prime which I think move in conjunction).</p>
<p></p>
<p>3) An aquaitance had recommended checking out Sallie Mae. While their interest rates look competitive, they don&#8217;t seem to offer an option to make both principal and intereste payment in school. I am looking to use this option to minimize the amount of interest that I end up paying on my loan. Does something it make sense not to consider SM because of the absence of sucn an option?</p>
<p></p>
<p>4) Can different banks offer me different rates even though my credit score is the same? This will determine the number of banks that I will apply to. Right now I am primarily looking at the incentives (like .25% discount with auto-pay) that banks offer because I am going off the assumption that they will offer pretty similar rates (the interest margin looks pretty similar for most banks). Am I correct to think this way?</p>

<p>5) Anything else I should keep in mind?</p>

<p>I tried to look at other posts but didn&#8217;t really find one that addressed these general questions. If there is one, please point me to it. Also, please feel free to share links or anything else that might help. I am happy to research, I just need some guidance to make sure I am on the right track. </p>

<p>At the end of the process I would be happy to write a long honking post (which as you can tell I don&#8217;t mind doing! LOL) summing up everything for the communitie&#8217;s benefit.</p>

We saved the letter the attorney sent along with the letter we sent to the attorney via certified mail.Â  Yes, we do have the delivery receipt.Â  Never heard back from the attorney or Portfolio Associates afterwards&#8230;. Until now.</p>

<p>The mark is still on my credit and Portfolio Associates is calling from various area codes twice a day at different times of the day.</p>

<p>Since the letter was sent to the attorney acting on behalf of Portfolio Associates do I have any legal grounds to stand on here?Â  In my opinion, since the attorney was acting in behalf of the CA, sending the letter in June 2010 to the attorney was the appropriate and correct action.Â Â  Should this collection e removed and should Portfolio Associates not be attempting to contact me?</p>
<p>Â </p>
<p>For the record, I have not claimed this debt to the CA.Â  In fact, I refuse to answer their calls.Â  What is the next step I should take?</p>

It doesn&#8217;t sound like they are willing to delete for payment as you requested but I might be misreading it and I&#8217;d certainly let others give their opinioons on this.</p>

<p>Most of this is very old (2007 &#8211; well before I knew about sites like this) but I really need to get this sorted out so&#8230;</p>
<p>I had a CitiAssist (private) loan that I screwed up on back in 2007. Citi is reporting to the credit bureaus every month that it was Charged-off/Written off (depending on which report you check) and the amount increases each month.</p>
<p>I went through some pretty bad credit handling back then and I suppose I was just ignoring it. I honestly must have forgotten about it as I did have the good mind to consolidate all of my federal loans later that year and those are fine. However, I take full responsibility.</p>
<p>What I recall is their internal collections department contacting me around Dec 2007 or so for payment (back then was ~$5000). Ultimately they demanded immediate payment or very large monthly payments that I told them was not possible. I was willing to pay $200/mo or whatever but they would not accept it.<br />Communication ended.</p>
<p>A few months later (so early 2008 or so) I received a certified letter from a collection agency in my state. The name of the agency appeared like a law firm but I am pretty sure it was just a collection agency. From information I read online, I sent a certified letter to them requesting debt validation (not saying it wasn&#8217;t mine and not refusing to pay). This may or may not have been the brightest thing to do since, even though it&#8217;s a Private loan, I think it goes by different rules (compared to like CC account) since it was a student loan.<br />Anyhoo, I never heard from them nor Citi again.</p>
<p>Â </p>
<p>Knowing I really need to get this resolved just within the last couple of weeks I logged on to their site and according to my online payment history on their website, the last payment I made was on 12/25/2007 but my loan is no longer listed within their system (&#8220;You do not currently have any active or fully disbursed loans on our system.&#8221; according to their website). I did have to update my Contact Information on their website to view anything so I assume that will trigger something somewhere that I&#8217;m still alive and how to contact me which is ok because I&#8217;m not trying to hide from them and I do want to pay.</p>
<p>Â </p>
<p>Again, it is Citi that is reporting to the CRAs every month that it&#8217;s charged off. No CA has reported anything. Since they are actively reporting it as a Charge Off and the amount is increasing (It is reporting at ~$7000 as of today), does this mean it is still in Citi&#8217;s hands?</p>
<p>I guess my biggest question is does anyone have any guesses as to what Citi would offer for payment options based on experience? It would be nice to have some idea so I don&#8217;t feel like I&#8217;m getting hit by a train when I get up the nerve to call them.</p>
<p>Also, from reading other posts I understand that they could still sue me even if I have arranged a payment plan with them and am paying as agreed. In your opinion do you think this is something they are likely to do? If I asked them would they know? Is there some time frame from defaulting on the loan that they just automatically start the process?</p>
<p>And I have dug through every last piece of paper that I have files and cannot locate anything related to this loan, if it matters.</p>

<p>I am wondering if anyone out there thinks there needs to be a reformation of the Unemployment Security System. The reason for this is the fact that we are not given a choice about having regularly appointed withdrawals from our paychecks from the time we begin to work.</p>
<p>It was intended to be a stop gap to help citizens in time of unexpected disconnect from work, to assist until new employment would be found. I would like to draw a comparison, and ask your opinion.</p>
<p>Â </p>
<p>Well over 20 years ago, car insurance was made mandatory, (as in we cannot drive legally without it). We are obligated without choice to pay into a â€œshared riskâ€ system, to protect us and the other involved persons in the case of an accident. It all sounds wonderful and even noble in some ways. But I ask youâ€”what happens when you HAVE an accident? Does anyone come rushing to your aide, or do you have to fill out reams of paperwork, sweat bullets wondering if you will be charged for something that was not your fault, or worse that your accident is deemed unworthy of help when you are at fault, and that in any case your rates will be raised with or without cause at whatever time frame and reason the applicable insurance company can come up with? Is it not even more interesting to note that those long years ago, as soon as car insurance was made law, the cost of it skyrocketed out of all sane reasoning? That in particular reminds me of the fact that we the taxpayers are shelling out 53 Billion dollars per year in royalties to gasoline companies (C-Span-Friday 3-04), which is on top of the perfectly adequate money they are already making!</p>
<p>Â </p>
<p>I donâ€™t think I could cover someone elseâ€™s costs in the case of a car accident on my own with savings, so insurance would be necessary for me, but after INVESTING so heavily, I find it repugnant to be censured and used like some endless source of revenue, as I CANâ€™T afford to cover these things myself. Thank heaven I havenâ€™t had an accident of the auto nature for a very long time.</p>
<p>Â </p>
<p>But to get back to unemployment compensation, how different is it? What reasoning can anyone use to jack money from our paychecks from the time we are still kids just beginning to work, and then make us beg for the money we invested at the most vulnerable times in our lives? It is not like we ask for more than we paid in, unless we receive an extension. That is already calculated to the exact penny by Uncle Sam. Why should we have to appeal to anyone for money taken from our own pay, and shelled out to those who are considered more worthy of OUR earnings? If our tax dollars pay to run the system, there are no losses incurred to it from its support structure except the job losses themselves, and not everyone who invests is going to lose their job. So whatâ€™s the deal? I would prefer not to be upset by this, and just sublimate it somehow, but many are in a financial mess because of job loss, and now find that they canâ€™t get or have to â€œpay backâ€ their own benefits without current employment. If it was to help with future job loss, it might be profitable in a way, but some are close to retirement and not likely to find new employment. How applicable would that be? The paperwork involved is, well, a job in itself. I believe it would be better to use the money taken out of our pay for personal bank savings on our own, with interest added in case of job loss in the future, from the beginning, instead of having money funneled away from our labor, which we probably will not be able to use without going through a sometimes demeaning and further laborious process. In other words, do you think that Unemployment Security is not a cost effective method to cover stress and monetary failure FOR THE CITIZENS who pay for it? I would also like to know if that money is used for any other purpose than for unemployed individuals. The information on that seems not clearly evident to me. Exactly how does this service benefit EVERYONE who pays for it, either at times of unemployment or at retirement? Is the money transferred into Social Security retirement benefits when each of us becomes too old to work? What does it feed when we die, anything we are made aware of? If you have any information in this regard, please post it? If this is not a cost efficient system for the American citizen, then it is time long past due for the American citizen to put an end to it, by public petition and vote. After all, we donâ€™t go around losing jobs for other people, and should not be penalized as though we did, if the insurance canâ€™t or wonâ€™t benefit all who are billed. This process also adds to the burden of the nationâ€™s employers in the reporting and extracting of the funds involved to be sent to the government. These benefits are not â€œentitlementsâ€. They are a debt that should be paid TO US in time of need, and if deemed in any other light should be ended, the monies involved being returned to the applicable citizens or their families after death. We are all too strapped to have our hard earned dollars be filched right out of our paychecks for any other purpose, and especially without the possibility of gaining interest for our personal use. Do you suppose that Unemployment Security invests it, and wonder what is done with the possible proceeds from the possible investment? Where IS our money going?</p>

<p><em><strong>I requested debt validation per FDCPA 809 from â€œCAâ€ and they have failed to respond. FDCPA states that if the CA doesnâ€™t or canâ€™t validate a debt, they must cease collection activities. The FTC has issued the opinion that reporting on oneâ€™s credit report is indeed collection activity.</strong></em></p>

<p><em>Question on this: Â I have 2 DV that were responded to but not properly. Â do I send a letter with the above infomation or do I state that it was incorrectly validated. Â  Also if I do continue to send the above statement to the CRA, Should I wait 30 days from the CMRRR date on the green signature form???</em></p>

<p><em>One is an apartment contract that doesn&#8217;t have the completed contract only parts of it (and not the part that states I owe concessions)</em></p>

<p><em>Other is through Assett Acceptance and it is a homemade (fake) statement through them that states a date I was married (and Ive never been married)- Â The amounts are also incorrect)</em></p>

<p>Â <strong>Beutler Air Conditioning Service is blatantly overchargingÂ  by </strong>up to 1000%<strong> For parts to prepare furnaces for the winter</strong>.Â  <strong>This action will affect hundreds if not thousands this winter</strong>.</p>

<p><strong>Beutler dispatched a tech to a clients home recentlyÂ as part of a prepaid maintenance contract. The tech recommended replacement of three parts on theÂ furnace.Â  All furnaces 10 years old or just out of warranty will receive at least these recommendation.<br />The tech initially stated $600 for the parts and eventually $500 for the parts. I signed the home improvement contract and paid with a credit card. The next day, feeling uneasy about the cost of the parts I researched them and discovered that the parts actually cost less than $75.00. I was overcharged more than $425.00 for the parts. I contacted Beutler&#8217;s Operations manager, Bill Roberts, on 21 Oct. He became contentious immediately which is the true sign of something not right.Â  Rather than review his inventory prices, he initially tried to accuse me of bad research by saying I didn&#8217;t have the right prices, but quickly dropped this lie. He then told me the $428 overcharge was the markup of their parts and it included consideration that a trained tech was replacing the parts and a 2 year warranty was included. This is all a LIE. I have a two year Home Service plan with Beutler that grants me a 2 year warranty on all repairs already. The tech was on site as a result of the scheduled Home Service Plan tune-up and no labor was charged. The prices of the parts were created on the spot based on the tech&#8217;s perception of my ability to pay (nice house) and not a real price catalog.! I&#8217;m sure beutler&#8217;s records will show multiple prices charged for the same items. In my opinion this company acted fraudulently and unethically and refuses to correct its error while fabricating more untruths. </strong></p>
<p><strong><br />The three items were for a York Furnace.Â </strong></p>
<p><strong>Based on retail internet prices;<br />Hot Surface Ignitor &#8211; $39.00 (max)Â  (actually $29 &#8211; $39)<br />Blower Capacitor &#8211; $18.00<br />Rollout Switch &#8211; $14.40<br />Total Cost = $72.40<br />Total Charged by Beutler $500.00<br />Overcharge = $427.60<br />After seeing the parts, it is clear that anyone capable of changing a 9 volt battery could have replaced them in </strong>less than 10 minutes.<strong>Â  No expertise was required.</strong></p>
<p><strong>Beutler and other furnace repair companies will perpetrate this same unethical act hundreds of times over the next few months as people worry about their comfort during the upcoming winter.</strong></p>
<p><strong>Consumers must be made aware of these scams during this dire economic time.</strong></p>
<p>Don&#8217;t sign anything until you research the part prices.Â  Call a handy man and save hundreds.</p>
