The judgement date on this was June of 2004. It was paid, and the case should read closed. On scorepower report it states it will fall off July 2011 but I want it off sooner as I’m requesting an auto loan.

 

Could I request a motive to vacate (from the plantiff attorney if he is nice enough to provide one) or is this passed the Statue of Limitations and I could tell the CRA to remove it? This was in the state of New Jersey.

 

A while back I disputed a medical bill from 2004 as I have no idea what the bill was.  It was deleted from all of my reports.  Today I found a letter burried in a stack from Sept 13.    It is a collection for the medical bill from before 9/3/2004. 

 

Indiana Statute of Limitations:

 

STATUTE OF LIMITATIONS (IN YEARS)

  • Written Contract (for payment of money before 9/1/1982): 10
  • Written Contract (for payment of money after 8/31/1982): 6

  • Domestic Judgment: 10 on real estate (renewable for additional 10); 20 against the person
  • Foreign Judgment: 10

 

So I have 2 questions.  1.  Can they report this again to my credit reports?   and 2.  As far as I understand, this is beyond the SOL, correct?

 

Suggestions?  Send DV or ignore this?

 

I’ve had this satisfied judgment on my report for 5 years and TU, EX have deleted it and no longer reporting this item, but…. Equifax just keeps verifing it. I have been going back and forth with Equifax and have atleast 3 letters from them stating that this Judgment verified and still reporting….Statue of Limitations for my state NY is that Satisfied Judgment reports for 5 year since day filed. This Judgment has been filed 5 years and one month ago. So, basicly Equifax has violated FCRA and reporting incorrectly? I just wrote them another letter and ready to mail it alone with Court Document with dates stamped on Court Document supporting my dispute…

 

At this point I have had enough of Equifax. Why EQ keeps reporting something that should be fallen off my report? I can’t even begin to tell you how many times I submitted request for investigation and it’s all for nothing. TU and EX were swift to remove this Judgment even before it was expired and all was done on line. With EQ I have a stack of US Mail Certified Letters I have mailed to them and all for nothing… just keep getting letters back saying “verified”.

 

The Request for Deletion for Expired Judgment, that I am mailing them now is very well done, firm, and has valid Court Document. I will keep my fingers crossed and hope I will not have to write them another request for Judgment deletion… if they still don’t do it, do I have to file in court against EQ?

First post to this forum.

 

 I have an old judgment from being evicted.  I learned about it from CRA.  Shows up as a “Civil claim judgment” on EX for $1326.  The date filed was 06/14/2004.   I never even heard of a judgment until I read about it on this site.

 

I hated the place; it was dangerous, I quite paying rent for several months and then moved.  I remember the court paper on the door while I was in the process of moving out. I never even read it, just ripped it off the door and continued with my move.  From what I gather a default judgment was place against me because I did not bother to show up to court? I was young and stupid, many years later now I am just stupid.

 

 I live in Macomb County, Mi and I have never had any type of garnishment or any pressure to pay.  Why not?  Who is supposed to hunt me down?  I have read about the term Statute of Limitations and am still not clear if it is 7 or 10 years and if that means it falls off my credit report regardless of it being paid or not paid.  Will I get charge interest if I try and pay up now. What should I do?  Any advice would be greatly appreciated.  In the mean time I will continue to study this forum to try and clear things up a bit.

I have an negative item on my credit report with the date of last payment being January of 2004.

 

The Statute of Limitations in my state (Ohio) is 6 years. I understand this means they can’t sue or take me to court now. But does this also mean the negative item should be deleted from my credit reports?
