Good Afternoon, i am hoping someone can help me.
I have been trying to rebuild my credit and I have finally made some progress. I am sitting around 690 on all 3. I have been pre approved for a mortgage and was looking froward to buying in the next couple of months.

This morning i got a complete blow to everything.
I have credit monitoring with Equifax and i recieved an alert and it stated the following.

 

Suit or Judgment information has been added to or changed on your credit file.

Court/ Case Number:

Satisfied Date: N/A

 

This was an account i had before i divorced, it was a joint account. It was for an automobile loan, it was repossesed and it states its charged off.  Date opened, 6/2001, reported since 2/2004, date of status 1/2005, last reported 12/2010. Other information, says charge off as of Dec 2010, Jan 2005, 30 days past due as of Apr 2004- Oct 2004. Account is scheduled to continue on record until Oct 2011.

 

I never recieved a summons or anything, i haven’t heard anything and someone informed me becuase of statue of limitations i might be ok since its 4 years in Texas. I am worried sick becuase i am supposed to buy a home in a couple of months and i cannot with a judgment. I have tried to rebuild my credit since my divorce 5 years ago and i finally have and now this. I do not see it under public records in my credit report. Will it show up immediately. Please help. I’m so worried. I don’t even know what to do at this point.

I’m so confused so I’m going to try to word this the best I can.

 

While in the process of applying for a USDA direct loan, the LO send me the pre-eligibility letter to me today and noted some concerns on my credit report.

 

The concerns were about two student loans that show up as profit & losses. I have called both MN Self Loans and Firstmark trying to clarify these but no one seems to know what they are from or why they are showing up on my credit report.

 

Here is what shows up on TU and EQ:

 

MN SELF LOAN.. OPENED 10/04.. REPORTED 09/09.. HIGH BALANCE 2,250.. LAST ACTIVE 10/08.. PAST DUE -0-.. BALANCE 2,195..  Profit & Loss Write off; Closed 03/09

 

FIRSTMARK.. OPENED 02/05.. REPORTED 08/09.. HIGH BALANCE 2,250..LAST ACTIVE 08/09.. PAST DUE -0-.. BALANCE 1,918.. Profit & Loss Write off; Closed 03/09

 

 

Now, here is the student loan that we are actually paying on and the information that shows up for it:

 

FIRSTMARK.. Opened 10/04.. REPORTED 08/09.. HIGH BALANCE 4,500.. LAST ACTIVE 08/09.. BALANCE 1,914

 

First, let me say that these credit report notations are from a credit report 10/2/2009. I pulled an Experian report in July but these do not show up. The USDA LO pulled a TU report on Wednesday. 

 

Here is the only explanation I can think of for this is that my husband consolidated his student loans sometime in late 2005/early 2006. He did this on his own, and he cannot remember what he did. He just said he “called the firstmark people and consolidated the loans and that’s what they did.” But when I called Firstmark yesterday, they have no records of consolidation. When I called the MN Self Loan people, they said that this account was paid off. My USDA LO wants to verify that these two profit & loss write offs are not a open and delinquent federal debt, because she said if we have a delinquent federal debt there is no way we could get a loan through a federal program like the USDA. I told the MN Self loan representative this, and she said USDA can always send in a debt validation letter and they can verify this isn’t a delinquent federal debt. Also, the MN Self Loan lady said that we should call TU and EQ and dispute the item on our credit report.

 

I am so confused. I am hoping someone who is a little more familiar with student loan debt and consolidation than I am can help me.

I am hoping someone can help me out. 

 

I recently received a letter from Enhanced Recovery regarding a $104 debt owed to TDBank from 9/07.  The debt was originally placed for collection with NCO Financial back in 1/2008.  At that time I contacted NCO who stated they had no record of the debt and would delete from all three credit reporting agencies (which they did). 

 

I had not heard a peep until I received this letter the other day, problem is that I had just pulled my annual credit reports and this did no appear on any of them at the time (5 days before the letter is dated). 

 

How can I handle this?  I have read and re-read and searched for a post that would point me in the right direction.  The debt is for a fee for an account I had closed.  I don’t want this to drag and continue to haunt me and I am willing to pay this in full but my problem is that I am not sure where to start.

 

Do I do a DV letter (I know the debt is valid), do I send a PFD but I don’t think they are reporting, the OC never reported it, only NCO did.  I am lost and have no idea what direction to take.  I have worked hard for the past 2 years fixing my credit to the point where I am at now and do not want a $104 account to ruin all my work.

 

Can someone please help, I am quite desperate at this point.

Good Afternoon Citizens!  I have a question, that I am hoping someone can assist me with…In viewing my report, I notice that an auto loan that we had, and paid off in full last July is showing in the Current status as “30 days past due” and the the Past due Amount  section as “not reported”….however, in the payment history, it states “0 times”  30, 60 and 90 days late.  Plus, ,it states balance as zero (as it should)   Any ideas on why it would  say 30 days past due?  Thanks much!

 

I have been looking everywhere but can’t find the info I need. I am hoping someone can help. Here’s what I have done so far

 

1. mysterious collection for $81 on 2 of my CR, one beinfg unpaid, other saying IIB, checked BK info, not included

2. called OC to find out what this bill was for, they explained, asked if I could pay them and if it would be pulled from CA, was told Yes

3. paid OC $81 and found out they had wrong address for me from the begining, meaning CA also had wrong addy

4. sent hippa disputes to CRA’s, updated to paid, other still saying IIB (?)

5. called OC again, was told I had to contact CA, they had done their part in updating to paid. which was the total opposite in what was told before, in that they would remove it if paid

6. contacted CA..got NO where

7. filed compalint with BBB against OC and CA

8. received BBB complaint info from the OC basically saying they have sent me detailed reasons why their decisions have been upheld. Also referring to HIPPA laws in why they are not sending BBB copy of letter that was sent to me

 

Ok..so now I am stuck. I can dispute their decision with the BBB, but am trying to find the right wording or legal codes. The OC “detailed” letter simply states that my account went to CA due to not having a viable address, not once mentioning anything medically so I am not sure why they put that in their response letter to BBB. I have NEVER received any written communication from them about this debt or by the CA. only after I gave them the correct address and disputed. My question…can a OC legally send an accout to CA if they do not have the right address on you?

 

I am hoping someone  can offer  some advice  on this one, as I  keep  running into dead ends.

 In 03  My husband  was  deployed  to Iraq and  his  ex wife had a  power of attorney. He came back to find her, everything he owned, and all his money  GONE.  Called  to  request POA   returned, she  claimed to have  detroyed it and  ( where his mistake was)  he accepted that at face value.  Fast  foward to  08. We start getting collection letters.  Seems  the ex  bought a car in his name,  didnt pay for it and  had it repoed.  Had all the letters  going to  her address in another state  so we never heard about it  for years.   till they tracked my husband  down  of course.  GMAC  already charged off the debt and  now a JDB   says we owe them  9 grand. They have sent  12  different CA’s   after us  calling and harrassing. I  actually sued the last one and   got a settlemnet  for  their illegal tactics and harrassing me  stating I  be married to my husband now owe this debt.

 Suffice to say  his  good credit  is ruined but from what we were able to track  down by calling GMAC, the dealership who let her buy this car in his name and  finally after 2  years a  copy of the paperowrk  is  she defaulted on this car  also in  03.   We are  of a mind to wait  it out but the JDB  reports  this as a current debt and has a different date.  Other than paying 9 grand  ( which we cannot)  for a debt that  was a  surprise to us,  we aren’t sure of our options. 

 I have explained  over and over to    the JDB and  every CA that calls  the circumstances to no avail.  I have been looking for  6 months for a lawyer that  can  handle this situation  or advise  us, no one  seems to handle this  debt situation either.

  If anyone has  any ideas  on how to  get this off our credit  or any recourse  we have, all advice  would be appreciated.( or a lawyer’s name)

We also  question the SOL time on this  because  when she did this my husband  lived in  CA  she  lived in and bought this car in Misourri and we did not find out of  it until we  had lived in Virginia for a few years.

  Any suggestions  on this mess?
