Ok, so I have a couple accounts still listed on my EX CR that are charged off. The date they have it to be removed is 7 years from the DOFD. According to the NYS FCRA they should be removed in 5 years from the DOFD because they are charge offs and that is NYS law.  BTW they are paid, not in full, but paid.

 

My question is, how should I dispute this? What should I say, and how should I say it in a letter to them? Also, should I send it to them now asking to them change the date of removal date, or wait until the 5 years are up and then contact them about it? EQ and TU have the accounts marked to removed at the correct dates following the NY FCRA.

 

I have read some articles which saw EX is HORRIBLE about following the NYS law. I even read that they think it has to be paid in full in order to apply when thats not what the law says. It just says paid. Has anyone else dealt with this and how did you handle it? Thx!

 

1. I talked to a couple of accounts today. Direct TV was closed in 2005. But the agency have it at 2007 and the current collections have it at 2009?? Ok how can they just change the date? I was told I can send a letter to Direct TV  to see if they will do a PFD but I am afraid if I do they will just change the date again and say I just paid it off and it will be on my report for 7 more years.

 

2. I also have an old phone bill. it went to collections and they sent me a letter for half the amount which I finally had the money and was going to pay it. I called and the guy said it went back to Verizon like the day before. They sent me a Bill and now want the whole amount ?  again if I call them and pay and ask for a PFD  will it just change the date to Now?? Its from 2007 I am not trying to skip on any payments I just don’t agree in any form that these items should stay with me for 7 more years….Thats Krazy….with a K. Ok so what can I say and what is going to be used against me…..

This is my first post but not my first time on the forums. I never have to ask anything because there’s usually someone on the forums with the same questions that I have. But I couldn’t find the exact answer to my problem anywhere, so I thought I’d share.

 

My next to last baddie (I have paid a charge-off set to fall off by 8/11) had a deletion date of 8/10 on my Experian report. I checked today and it was still there, and I read somewhere on this forum that Experian usually removed them closer to the end of the month. I also read that just because the date was listed on your report as such, it didn’t necessarily mean that it was the date that the tradeline was supposed to be removed. Many times the bureaus would change the date based on updated information. With that in mind, I didn’t formally dispute the date. :smileyindifferent:

 

However, because I need to move by the end of the month (and SafeRent uses Experian), I needed this charge-off removed ASAP. So I simply called the Experian dispute line, (dialed “0″ a million times), and asked the service representative when the exact date was that I should expect this item to fall off. She said that it was scheduled to be removed today but it wouldn’t formally leave my report until the end of the month. But because I called her today, she would have it removed within the next 24 to 72 hours. She then asked me if I would like an email confirmation that this item had been removed! *gasp*

 

Might I also add that she was very courteous and polite, and handled my concerns swiftly. I never formally asked for a dispute- I only referred to the line item on my credit report- and she handled it right then and there. I immediately hung up the phone and did somersaults across the living room floor. I then checked my report and it said that the item was in dispute.  I checked again three hours later it had been completely removed from my report. Needless to say I am still in complete shock as I didn’t expect this from Experian. I only wish that I’d press “yes” for the customer satisfaction survey before I began my customer service interaction.

 

I wish I knew when Equifax was set to remove the same tradeline- but I’ll let sleeping dogs lie…

My husband and I are looking to purchase a home fairly soon and are needing some advice. We were looking over my husband’s credit report with a real estate agent this morning and a few of the things he mentioned to us did not seem correct to me. My husband defaulted on a car loan in 2003 and our real estate agent mentioned that this debt could stay on his credit report indefenitely since a lot of debt collectors change the date of activity to a recent date in order to continue collecting on the debt. He pointed out to us that this debt was last reported to the bureaus this month, and that we had to wait 7 years from that date until this would be removed from our report. I later noticed that underneath the “date reported” were the letters “DLA”, which I discovered meant date of last activity. This date was listed as 02/2005. Does this mean that the CA will stop reporting this debt 7 years from the DLA, or is it true what my real estate agent mentioned about this being reported indefenitely, and that CA reporting debts for extremely long periods of times is actually something quite common and very hard to fix….

 

I’m also keeping in mind that our real estate agent wants us to go to a debt restoration agent to help us fix our credit; however, we’re not sure if we should even pay back this debt as we were assuming it would be dropping from our credit reports fairly soon (w/in 2 years the most).
