I have a letter im sending to CA re: verbal Payment plan made over the phone that i would like in writting. This i what I have so far. What do you think? Did i leave anything out? Would you change something? Let me know, thanks!!!

This letter is an attempt to clearly state terms of verbal agreement made on the remaining balance owed on the following account. A WRITTEN agreement protects both the parties from discrepancies and disputes later.

1. (Account number)

The total amount owed on this account is ($ X).

1. (CA) agrees to accept a payment arrangement as settlement of the balance owed on (account number). The payment term will be for (X) months, beginning in (3/25/2011) and ending in (date of the last payment). A monthly payment of ($ 50) over the next (Z) months will be paid to (ca) as an agreed full and final settlement of all outstanding charges and fees on (account number). Each monthly payment will be due on the 25th day of the month.

2. (CA) agrees to delete ALL information regarding this account from the credit reporting agencies and will not discuss the terms of this settlement with anyone, excluding your client on this account. If contacted by any third party, including credit-reporting agencies, Collection Agency will not acknowledge that any settlement offer was made, accepted or executed and will, in fact, deny knowledge of any such account (CA) reserves the right to resume collection attempts only if (your name) does not adhere to the payment schedule outlined in item #1. Once the entire balance has been paid off in full, (ca) agrees to permanently cease any and all attempts to collect on (account number), since (creditor name) would recognize the account as being paid in full.

3. (Creditor name) agrees not to sell the debt owed on (account number) to any third party, provided that (your name) adheres to the payment schedule in item #1. (Creditor name) reserves the right to resume collection only if the payment schedule is not adhered to.

4. (Your name) may pay off the remaining balance prior to the end of the payment schedule without penalty.

5. This agreement is binding on both parties.

If you completely agree to points 1 through 5 listed in this offer, please have an individual authorized to make such agreements on behalf of (creditor’s name) sign and return a copy of this offer to the return address listed at the bottom of this page. The individual who signs on behalf of (creditor name) must have express authority to make such agreements binding upon (creditor name) or the agreement is void. It will be implied that this letter shall constitute a legally binding contract, enforceable under the laws of my state.

 

As a show of good faith I’ve enclosed my first payment in the amount of $__50_. I would appreciate a call from you confirming your acceptance of my payment terms. Yep…$41.00.  Bad little surprise to me-we thought we paid our final bill when we moved out. 

 

I tried a PFD but they replied they do not delete once paid-only report it as paid. 

 

My question is regarding the “CO” reporting below and the fact it’s reported as “installment”.  Is this impacting my score?  Also-since it is an old energy bill that went to collection-is it valid that they report it as “installment” and a “CO” ?

Any Suggestions how to deal with medical CA reporting 3 years later?

Hi,

 

I had a medical bill (that I didn’t even know about to begin with! – seriously, I never got a normal bill, just a letter one day from a CA). Anyway, it went to collection, which I paid *immediately.*  At the time, the letter said that if I called and paid immediately, I’d only need to pay x amount – a “discount opportunity,” they called it. That was over three years ago.

 

As of Jan. of last year, this started showing up on my CR!!!  :

 

I still have the CA’s letter *and*  the confirmation number for my payment (including the date and time I paid it).  Is there anything at all I can do here? Would a GW letter help me?

 

I just don’t understand — why bother reporting it 3 years later?? And they never told me that it’d show up as an “account paid for less than full balance.” What the??

 

This may not normally be a big deal, but I’ve been working insanely hard over the last 1.5+ years to clean up my old messes that this just seems like an un-necessary setback. Please help.

Want to delete a paid charge-off from Victoria Secret Card

Hello All,

 

I have been out of country from 2005-2008, then when I returned, I realized that I had one credit card opened from Victoria Secret and didn’t pay.

I contacted to collection agency (Accept Acceptance, LLC, in Michigan) and paid in full.

 

However, it still stays in my credit report.  I sent few letters to CO & Victoria secret but they both don’t want to delete.

In this case, how can I delete?  I am very concerned as this seriously lowers my credit score right now.  

 

Please help me!!

Is This Reporting Correctly

The below entry is on Equifax.  I had a student loan that I let get 120 days late in 2006.  Then I consolidated and it is with a new compnay now.  My current status is shown as 120+ days late for this.  Is that correct?  Because it is not currently 120 days late.  They were paid and it is now closed.

Online Disputes – Is Equifax the worst?

I disputed 2 items with Equifax last month.

 

There was a credit inquiry listed with no company name or information – Equifax verified it! No company name or information and it’s verified???

 

I disputed an HSBC revolving account that was closed and charged-off. This dispute was investigated and “verified”.

Now the HSBC account is listed as collection and went from 0 balance to 968.

Now it has identical account number and balance as National Credit Adjusters. So they are now listed as duplicate collection accounts. My score dropped 40 points.

 

Now I have to dispute these duplicate accounts.

 

I have decided to handwrite the dispute and mail it to Equifax.

 

Is Equifax the worst CRA?

This is from my wife’s report. Actually there are two just like this from Fairfax county on her report. It was a few years ago and she said it was the county’s mistake (which I doubt) They’re no other collection’s on the report even though it says someone was hired. Does she DV this or will it awake someone? Portfolio Recovery Ass. has been chasing her for some reason for years and maybe this is the reason. Still learning things and preparing to buy a house in 10 months or so. Her score is 704 so maybe it isn’t hurting too bad? Thanks all!

Help w/Cap 1 Garnishment with Mann Bracken

My dh has a garnishment on his cr from cap 1.  It was filed 1/5/2005.  The issue is:

 

1. he was never served for this, they used an incorrect address so we had no idea of this until we pulled his cr. 

2. he’s never had a card w/cap 1 ever, so we don’t even know where this came from

 

the amount is for $2227.51.  The only action we’ve taken on this is disputing it w/the cb & it came back valid.  Which I can understand since they’re probably only investigating that it is a valid judgement.  My question is how should I proceed w/this.  If I try to send a dv letter I have no account number to reference b/c all he has is the judgement.  So, should I file a motion to vacate due to never being served & feeling as though this is a fradulent judgement?  I’m confused on how to handle this, but this is the last thing we have left to tackle on his report.

2 Collections listed on TU & EQuifax

Hi Everyone,

 

I have a quick question. I just recently purchased my score here on MyFico & went directly to Experian. My scores are: TU: 707 EQ: 655 EX: 606. I will be applying for a home loan in the middle of March. I’ve been reading and it looks like for home loans, they use the middle score. So, I am assuming they will be using Equifax score of 655. I have 2 collections on my TU that I want to get rid of and maybe my score will jump before I start the loan process. Should I DV them or PIF. There’s 1 colletion that is for Hawkeye Adj and I have no clue what that is.

 

Collection on debt to: The collection agency “Hawkeye Adj” was hired to collect a debt originally owed to “First Federal Savings Bank” on account number “XXXXXXXXX”.

On my Equifax report there is none under Collections but MIDLAND collection is under the Accounts Tab. Midland is also under my TransUnion under Collections.

 

What are your thoughts on how I should tackle this?

 

Also, do I need to worry about Experian? Experian score is very low compared to the other 2.
